Course detail: Constitutional Disclosure: Navigating Brady and Giglio in Modern Kansas Policing

Course Description:

This interactive four-hour Zoom course explores the constitutional mandates of Brady v. Maryland and Giglio v. U.S. and their profound impact on Kansas law enforcement. Designed specifically for officers, investigators, and agency administrators, this class breaks down the legal evolution of the "Brady Rule," examines recent case law developments, and defines your obligations in identifying, documenting, and disclosing potential impeachment evidence. You will learn how the prosecution's duty to disclose directly affects internal affairs, officer credibility on the stand, and case outcomes in Kansas courts.

Learning Objectives:

  • Differentiate Constitutional Disclosure Requirements: Contrast the prosecution's obligation to disclose exculpatory evidence (Brady) with the duty to disclose evidence affecting witness credibility (Giglio), applying these concepts directly to Kansas criminal cases. 
  • Identify Impeachment Evidence in the Field: Recognize what types of officer conduct, personnel history (e.g., untruthfulness, sustained disciplinary actions), and investigative practices constitute potential Giglio material. 
  • Analyze Kansas-Specific Case Developments: Discuss the operational impact of relevant Kansas court rulings and local federal precedents regarding law enforcement personnel files and the creation of local prosecutor "Brady Lists".
  • Formulate Compliant Reporting and Evidence Handling Protocols: Apply best practices for documenting and communicating potentially impeaching information to local prosecutors in a timely manner to prevent case dismissals or evidence suppression.

Using an interactive, web based platform, participants will actively engage in guided discussion, scenario based questions, and real time polling to explore how recent legal changes influence decision making, officer safety, investigative practices, and agency policy.

The University of Kansas has determined that the Kansas Law Enforcement Training Center (KLETC) main campus in Hutchinson and its regional sites in Dodge City, Hays, and Parsons are separate campuses. This determination was made in consultation with the Department of Education. The report is available online: https://civilrights.ku.edu/clery. The report contains information regarding campus safety and security including topics such as: campus law enforcement authority; crime reporting policies; campus alerts (Timely Warnings and Emergency Notifications); fire safety policies and procedures; programs to prevent sexual assault, domestic violence, dating violence, and stalking; the procedures the institution will follow when one of these crimes is reported; and other matters of importance related to security on campus. The report also contains information about crime statistics for the three most recent calendar years concerning reported crimes that occurred On-Campus; in On-Campus Student Housing Facilities; in Non-Campus buildings or property owned or controlled by the institution or a recognized student organization; and on Public Property within, or immediately adjacent to and accessible from, the campus. The report also contains fire statistics for any fires occurring in an On-Campus Student Housing Facility during the three most recent calendar years.  A paper copy of the report will be provided upon request.
