Course Detail: PSYA - Legal Updates for School Psychologists: Emerging Special Education Issues, Risk Areas, and Practical Guidance
School psychologists are increasingly operating at the center of some of the most heavily litigated and scrutinized areas of special education practice. This session examines recent legal developments and emerging risk areas affecting evaluations, eligibility determinations, mental health supports, behavior intervention practices, progress monitoring, Section 504, and dispute resolution under IDEA. Participants will explore how courts and hearing officers evaluate the quality of assessment data, documentation, team decision-making, and responsiveness to student needs. The session also addresses current concerns involving AI-generated reports, culturally and linguistically responsive assessment practices, dyslexia and reading litigation, manifestation determinations, and the growing expectation that districts demonstrate not only procedural compliance, but meaningful educational benefit supported by defensible data and instructional decision-making.
Specific learning objectives:
1. Analyze recent legal decisions and emerging litigation trends impacting school psychology practice under IDEA, Section 504, and the ADA, including issues related to Child Find, evaluations, behavior, and mental health.
2. Identify legally defensible practices for conducting and documenting evaluations, eligibility determinations, reevaluations, progress monitoring, manifestation determinations, FBAs, and BIPs, while recognizing common areas of legal vulnerability.
3. Develop practical strategies to improve parent communication, collaborative problem-solving, and professional decision-making, including addressing emerging concerns related to AI-assisted report writing, confidentiality, bias, and responsiveness to student progress data.
