Course Title: (HIS11926) BILL OF RIGHTS AS A FRAMEWORK OF LIBERTY
These classes (4) will provide a historically grounded explanation that captures the political, philosophical, and practical reasons the Bill of Rights became necessary and became the Guardian of Liberty. This is a 4-part class with the following topics for each class:
- 1st Session: With a Constitution, why did we need a Bill of Rights? James Madison wrote to reconcile competing political interests, divergent philosophies, public demands, and institutional concerns.
- 2nd Session: How the Amendments created a Framework of Liberty. Creation of a Constitutional Ecosystem
- 3rd Session: Penumbra Rights and the Ninth Amendment. Liberties living in the shadows.
- 4th Session: How Incorporation Doctrine reshaped the Bill of Rights. Shifting of power from states to the Federal Judiciary.
